In an indictment filed on November 25, 1981, appellant was charged with three counts of selling heroin and three counts of heroin possession, all in violation of § 33-502 of the former Uniform Narcotics Act, D.C.Code § 33-502 (1981), repealed by D.C. Uniform Controlled Substances Act, D.C. Code §§ 33-501 to -567 (1983 Supp.). The case was dismissed on July 6, 1982 for want of prosecution. A second indictment...
