OPINION

BROOKSHIRE, Justice.

Appellant was charged by indictment with possession of cocaine under TEX. REV.CIV.STAT.ANN. Art. 4476-15, Sec. 4.04 (Vernon 1976); the offense was said to have occurred on February 9, 1980. After pleading not guilty, a jury found Appellant guilty. Thereafter, the punishment was set by the Court at four years confinement.
