The defendant was convicted of attempted second degree arson, Section 564.011, RSMo.,1 by a jury in the Circuit Court of Lafayette County. Under the persistent offender act, Section 558.016, RSMo.Supp. 1982, and in accordance with the verdict, the trial judge sentenced the defendant to a term of seven (7) years imprisonment.
