Kenneth Ciarcia, appellant, appeals the trial court's denial of his motion for a new trial following his conviction on a charge of aggravated murder. The ground for his appeal is based on his co-defendant receiving a new trial. Appellant argues that because he and his co-defendant stand in the same legal position, he (appellant) also is entitled to a new trial. For the reasons given below, we affirm the judgment.
