Wilfred Hines appeals the lower court's upward departure from the presumed sentences under the Minnesota Sentencing Guidelines. Hines was charged with simple robbery of an occupied dwelling, theft, and two counts of receiving stolen property. He pled not guilty and a trial was held. The jury found him guilty on all counts.
