Appellant, Jessie R. Chambers, was indicted for murder. Following trial, a jury returned a verdict of guilty on the lesser included offense of voluntary manslaughter.

The facts are not complicated. During the early morning hours of August 6, 1978, appellant was sitting near the fountains in Hanna Mall. The decedent struck him in the shoulder with an object. Appellant got up, walked a distance of five to eight feet...
