Defendant-appellant Billy Barger was found guilty by a jury in the Jennings Circuit Court on February 9, 1983, of the crimes of battery, a class B misdemeanor, confinement, a class D felony, and was further found to be a habitual offender. The trial court subsequently sentenced him to a term of six (6) months on the battery charge, four (4) years on the charge of confinement, and further enhanced that sentence by thirty (30) years on the finding...
