Plaintiff, the Equal Employment Opportunity Commission ("EEOC") brought this civil action to enforce the Equal Pay Act of 1963 ("EPA"), 29 U.S.C. § 206. EEOC alleges that defendant, Delaware Department of Health and Social Services ("DHSS"), is violating the EPA by paying lower wage rates to female employees than it pays to male employees performing substantially equal work.
