WALTON, Associate Judge:

Appellant was arrested on a warrant on February 15, 1983, and charged with first degree murder while armed — felony murder. D.C.Code § 22-2401, 3202 (1981) (§ 22-3202 amended after dates relevant to this case, Supp.1983). On the following day, February 16, appellant was presented before Commissioner Evelyn Queen and held without bond pursuant to D.C.Code § 23-1325(a) (1981 & Supp.1983).1
