On December 29, 1982, the defendant was indicted for attempted murder in the second degree. The defendant was released from custody when the surety, Julio Varela, posted $7,500 cash bail on January 13, 1983. On June 24, 1983 defendant failed to appear before Justice Shirley Levittan in Part 30 of Supreme Court. Justice Levittan ordered the bail forfeited and a bench warrant.
