After counsel for all parties had made their opening statements to the jury, during which the plaintiff, Donald W. Hayes (plaintiff), made no reference whatsoever to his claim that defendant, International Union of Operating Engineers, Local Union 320 (Union), wrongfully or arbitrarily failed to carry plaintiff's grievance the final step to arbitration, it became quite apparent to the Court that plaintiff's case...
