BRETT, Judge:

On December 14, 1980, Samuel Earl Holding, the appellant, was driving his pickup truck west on State Highway 37 when he collided with a motorcycle. The motorcyclist died from injuries sustained in the accident. The appellant was charged in the District Court of Grady County, Case No. CRF-80-216, with committing Manslaughter in the First Degree in violation of 21 O.S. 1981, § 711(1) on the theory that the death was effected by the...
