ELKINGTON, J.

The several above-named defendant public entities and officials appeal from a summary judgment in favor of plaintiff Paul Schaeffer, as trustee, declaring certain municipal annexation proceedings to be invalid.

The uncontroverted material facts upon which the summary judgment was based follow.
