This is a sequel to an original action brought by Bill R. Turner, District Attorney of Brazos County, seeking issuance of writs of mandamus and prohibition in which relief was found by the Court to be appropriate. State ex. rel. Bryan v. McDonald, 662 S.W.2d 5 (Tex.Cr.App.1983) [hereinafter Bryan v. McDonald].
