Plaintiff Carroll James Fanguy brought this medical malpractice action against the United States under the Federal Tort Claims Act ("FTCA"), 28 U.S.C. § 2671, et seq. Fanguy alleges that he lost both his legs to amputation as a result of the refusal of the Veterans Administration ("VA") Hospital in New Orleans to admit him for treatment on November 2, 1980.
