This action is before the court on defendants' motion to dismiss certain counts of plaintiffs' complaint, pursuant to Fed.R. Civ.P. 12(b)(6). The basic allegation of each of the disputed counts is that the defendant insurers ("the insurers") breached their duty to deal fairly and in good faith with plaintiffs, thereby causing plaintiffs emotional and physical injury.
