On May 17, 1983 appellee filed against appellant Sears, Roebuck & Company ("Sears") a suit for property damage in the amount of $28,327.56 allegedly caused by water leakage from a refrigerator and icemaker manufactured by John M. Frey Company ("Frey") and sold and installed by Sears. The complaint was brought in three counts: (1) defective product; (2) negligent installation; and (3) breach of implied warranty.
