BRYNER, Chief Judge.

After entering a plea of nolo contendere, Larry Bratcher was convicted of theft by receiving in the second degree. AS 11.46.130(a)(1); AS 11.46.190. Superior Court Judge Victor D. Carlson sentenced Bratcher to serve four years' imprisonment. Bratcher later filed a motion to withdraw his nolo contendere plea and reinstate his original plea of not guilty.
