Plaintiff sued defendants in a three-count second amended complaint for breach of an insurance contract (count I), for the independent, wilful tort of fraud (count II), and for intentional infliction of emotional distress (count III). In response to defendants' motion to strike and dismiss counts II and III for failure to state a cause of action, the trial court dismissed count II with prejudice...
