James W. Barberousse was indicted for the commission of a negligent homicide. He was accused of killing his sister, Bonnie Lou Barberousse Jenkins in violation of LSA-R.S. 14:32.1 He was convicted by a jury and, pursuant to LSA-C.Cr.P. art. 893.1, the trial judge imposed a sentence of five years at hard labor without the benefit of probation or parole. The defendant appealed his conviction and sentence alleging eight assignments...
