The defendant, Earl James Smith, was charged with two counts of felony theft in violation of La.R.S. 14:67 and one count of forgery in violation of La.R.S. 14:72. Smith moved to quash these prosecutions alleging that the state failed to commence his trials within two years from the dates that the prosecutions were instituted. The trial court denied these motions. Smith pled guilty to the charges and reserved the right to appellate review of the trial...
