MEMORANDUM OPINION AND ORDER

NEESE, Senior District Judge, Sitting by Designation and Assignment.

The petitioner Mr. Paul Eugene Allen applied pro se for the federal writ of habeas corpus. He claims he is in the custody of the respondent-warden pursuant to the judgment of January 6, 1983 of the Criminal Court of Sullivan County, Tennessee in violation of the Constitution, Fourth Amendment, Right against Unreasonable Searches and Seizures Clause;
