CARTER, Justice.

In 1978, the appellant, petitioner Richard Schrier, was indicted for murder as a result of the death of his two-year-old son. After a trial to a jury, petitioner was convicted of murder in the first degree and sexual abuse in the first degree. Petitioner effected a direct appeal to this court, which was based solely on a sufficiency of evidence issue. We affirmed his conviction in State v. Schrier, 300 N.W.2d 305
