Defendant Kenneth A. Barrilleaux was indicted by a federal grand jury on two counts of federal income tax evasion (26 U.S.C. § 7201) and two counts of subscribing to false income tax returns (26 U.S.C. § 7206(1)) (R. Doc. 1). At the jury trial the defense moved for a judgment of acquittal as to all counts, arguing, as to the tax evasion count, that an affirmative act of concealment had to be found to convict the defendant.
