This case arises from a dispute over the classification of certain real and personal property in the estate of Jennie Chianelli Godefroy. The matter was heard before a commissioner and in accordance with his recommendations judgment was rendered by the district court. The husband of the deceased, Westley Godefroy, appeals from that portion of the judgment which held Jennie Chianelli Godefroy was the owner of a one-third interest in the real property...
