SCOTT, Justice.

Defendant was charged with escape from custody, theft, and unauthorized use of a motor vehicle. Minn.Stat. §§ 609.485, 609.52, subd. 2(1), 2(5)(a), 609.55 (1980). Defendant waived his right to a trial by jury and was tried by the trial court in a bifurcated trial. The trial court found defendant guilty of escape and theft. The court ruled that defendant had not met his burden of proving that he was not guilty by reason of mental illness....
