This is an appeal by defendants John Deere Company and Deere & Company (hereinafter Deere) from the trial court's dismissal, without prejudice, of plaintiff's action on plaintiff's motion for dismissal without prejudice. (Ill. Rev. Stat. 1981, ch. 110, par. 2-1009.) The focus of this appeal is section 2-1009:
