MEMORANDUM AND ORDER

Presently before the court is an appeal by a trustee in bankruptcy. The trustee is appealing an order of the bankruptcy court which modified an automatic stay1 and required the trustee to turn over certain goods in trustee's possession to the buyer of the goods. The facts, as set forth by the bankruptcy court, are undisputed.
