TYSON, Judge.

John Ricky Reeves was charged by indictment with the forcible rape of the prosecutrix, in violation of Title 13A-6-61 Code of Alabama. The jury found the appellant "guilty of rape in the first degree" and the trial court, following a habitual offender hearing, set sentence at life imprisonment without parole.
