This suit was filed by plaintiff-driver, injured in a collision, against the investigating police officer, for failing to properly submit or file an accident report, and the City of New Orleans, as his employer. Plaintiff contended that the negligent and unlawful act of omission deprived him of the opportunity to ascertain the identity of the other driver and pursue his claim.
