Defendant, Melvin King, was charged with capital murder and jury-convicted of murder in the second degree. He was sentenced to 25 years' imprisonment in accordance with the jury's recommendation.

Viewed in the light most favorable to sustain the jury verdict, the evidence was that on the evening of May 17, 1979, a 21 year old girl, Linda Johnson, was driven to Beefmaster's, a restaurant and bar in Newton County, Missouri, by her brother...
