In March, 1982, defendant was indicted by a Tioga County Grand Jury for two counts of rape in the second degree, two counts of incest and one count of sexual abuse in the second degree. The first and second counts of the indictment charged defendant with rape in the second degree and incest, respectively, in connection with an incident on April 17, 1979, wherein defendant allegedly engaged in sexual intercourse with his daughter, Kelly M. James, who was then under 14 years...
