DONIELSON, Judge.

Petitioner appeals from the dismissal without hearing of his application for post-conviction relief. Petitioner asserts that genuine issues of material fact were raised in the petition and that an evidentiary hearing should have been held. The State argues that petitioner's application was properly dismissed since the record clearly indicated that petitioner was not entitled to postconviction relief.
