OPINION AND ORDER

This case presents an enigmatic question as to whether members of the public have either a federal constitutional right, guaranteed by the First Amendment, or a right under the Rhode Island Open Meetings Law, R.I.Gen.Laws (1976) § 42-46-1 et seq. (the "Act"), to tape record a public meeting of a community school board.1
