This case, which was tried on the facts without a jury, arises out of the government's seizure of claimant Brenda Segev's 1980 BMW automobile after she was arrested for her involvement in an illegal sale of 10,000 methaquaalone tablets. The government alleges that the BMW was used to facilitate the drug sale and should therefore be forfeited to the United States pursuant to 21 U.S.C. § 881(a)(4) and 49 U.S.C. § 782.
