Defendant, David Wells, was indicted on one count of forcible rape (La.R.S. 14:42.1), and following a jury trial, he was convicted of that charge by a 10 to 2 jury vote. Subsequent to a pre-sentence investigation, the trial court sentenced the defendant to the minimum statutory penalty of two years at hard labor.
