Convicted in Queens County Court of robbery in the third degree, petitioner was given an indeterminate sentence of imprisonment of one to seven years on November 20, 1975. He served his sentence until February 11, 1977 when he was released on the basis of an Appellate Division, Second Department, decision which reversed his conviction due to a lack of sufficient evidence and dismissed the indictment (People v Jackson, 55 A.D.2d 961
