Appellant Oscar Bent, a Colombian juvenile, was arrested by Coast Guard officers in July 1981 on board the "ROBIN", a sixty-foot American shrimp trawler anchored twenty miles south of Cape Romano, Florida. A fishing moratorium was in effect in the waters surrounding the remote Cape Romano area, and the ROBIN did not carry fishing gear or display a flag. It was, however, equipped with sophisticated electronic equipment and it carried 6,520 pounds...
