Defendants were jointly indicted and tried for unlawfully manufacturing with intent to distribute methamphetamine (Count 1), and attempt to commit the crime of manufacturing with intent to distribute phencyclidine (Count 2). The jury found defendant Lush guilty of Counts 1 and 2, but found defendant Flake guilty of Count 1 "by aiding and abetting," returning a finding of not guilty as to the attempted manufacture with intent to distribute...
