Plaintiff appeals as of right from an order of the Court of Claims granting defendant's motion for accelerated judgment, GCR 1963, 116.1.

Plaintiff's decedent, Herbert J. Potes, died as a result of injuries he sustained in an automobile accident which occurred on Ballenger Highway, south of Miller Road, in Genesee County.
