This is an action in equity brought by the plaintiff, Dan Harlan (Dan) to impose a constructive trust for an undivided one-half interest in a seven acre tract of real estate that had been transferred by his deceased step-father, John Bishoff (John) to John's brother, the defendant, Wilbert Bishoff (Bert).
