This matter comes before the court on the motions of defendants Richard L. Jenks and the Town of Wardensville, West Virginia, to dismiss or for summary judgment. Plaintiff, administrator of the estates of Lottie Lou Bays and Janice J. Bays, brings these consolidated diversity suits for wrongful death.
