John Crews Rainey appeals from a judgment of the United States District Court for the Southern District of New York, Sweet, J., which dismissed appellant's complaint at the close of a bench trial. Appellant had sought to recover damages from Nouvelle Compagnie De Paquetvots, CIE., the owner/operator of the cruise ship M.S. Mermoz for injuries sustained by him while a passenger on the ship.
