Steven Atwood was charged with second degree murder for having stabbed and killed Dennis Tull during a barroom fight. Atwood freely admitted the stabbing, but he claimed self-defense. At trial he was convicted of involuntary manslaughter. He appeals from the judgment of conviction, contending that the court committed prejudicial error in giving the jury an instruction on the lesser included offense of involuntary manslaughter.
