This action was brought under section 167 (subd 1, par [b]) of the Insurance Law following inquest and entry of judgment against respondent's insured, the City of New York. Transamerica failed or refused to defend its insured in the underlying personal injury action, wherein judgment was entered in favor of plaintiff in the sum of $15,000, plus costs.
