The appellant, Jackie Dale McBee, and a co-defendant, Carl Howard, were convicted of the kidnapping and aggravated rape of an eleven year old girl. Each man was sentenced to not less than four nor more than ten years in the state penitentiary for the kidnapping charge and life for the rape. The sentences were ordered to be served concurrently.
