OPINION

ELKINGTON, Acting P.J.

Defendant Jesus Mizchele was convicted on a jury's verdicts of the second degree murder of his wife, Nawassha, by use of a firearm, and of possession of a concealable firearm by one previously convicted of a felony. His appeal is from the judgment under which he was sentenced to state prison.

For the reasons we now state, we have concluded that the judgment must be reversed.
