The plaintiffs, James Lee and his spouse, Norma, (the Lees), bought a house built by the defendant Alcide Morin (Morin) in Scituate, Rhode Island. Soon after the Lees moved into their new home, the city of Providence (Providence) through its Water Supply Board, seeking to convey water from the Scituate Reservoir to the city, acquired the lot adjacent to the Lees' house and constructed an aqueduct on that lot.
