Appellant was indicted and convicted under § 13A-5-40(a)(2), Code of Alabama 1975, for murder by the defendant during a robbery in the first degree or an attempt thereof committed by the defendant. After a separate hearing on aggravating and mitigating circumstances, the jury fixed appellant's punishment at life imprisonment without parole.
