OPINION

KAUFMAN, J.

Following hearing on an alternative writ of prohibition, the superior court denied issuance of a peremptory writ and the petitioners appeal.1 At issue is the constitutionality of subdivision (b) of Vehicle Code section 23152. We conclude the statute is not unconstitutional and affirm the judgment.
